Dudley Police Department Recently, I was asked a question about objects hanging from a vehicle’s rear-view mirror. These can include a handicap placards, parking passes, or decorations of some kind. Is there an issue if you drive with these things hanging from the mirror? The law, which can apply when items are left hanging from a rear-view mirror while driving, is found under Massachusetts General Laws Chapter 90 Section 13. This law contains the definition for “impeded operation.” It states in part, “No person, when operating a motor vehicle shall permit to be on or in the vehicle or on or about his person anything which may interfere with or impede the proper operation of the vehicle or any equipment by which the vehicle is operated or controlled…” This definition covers many situations and they are handled by police on a case by case basis. According to this law, items cannot block windows, cover mirrors, or interfere in any way with a driver’s ability to safely operate the vehicle. The presence of placards or other items could be considered an impediment to the clear view of a driver in many cases. The rules can also pertain to other things such as dash cameras, GPS Units, ornaments, large air fresheners, etc. A violation of this law carries a $35 civil assessment. |
It is important to have a clear and unimpeded field of vision as well as a distraction free driver compartment. Take the time to remove items which may be an impediment. This small step could make a big difference in preventing an accident.
