Recreational vehicles’ operating on
roads was the subject of a recent question. Four wheel vehicles or snow
mobiles in the winter can be seen traveling on or along public ways from
time to time. I was asked if a car driver would be at fault if it
collided with a recreational vehicle crossing a road?
Most of the recreational vehicle laws are covered by
Massachusetts General Laws Chapter 90B. Section 25 is the portion of
the law which pertains to these vehicles crossing roads. Recreational
vehicles must come to a full and complete stop before crossing any
road. When they cross, they must do so in a fashion which is as direct
as possible. They must not interfere with the free movement of
vehicular traffic on the road and they must yield the right of way to
all vehicular traffic when making the crossing. The penalty for a
violation of this law is a maximum $100 fine or up to sixty days in jail
or both.
Although it would appear any accident would be the fault of
the recreational vehicle, it is impossible to make that assumption. All
accidents are looked at on a case by case basis and a vehicle operator
cannot be given blanket protection from fault. The best practice is to
use caution, drive defensively, and always be aware of your
surroundings. This will best prevent accidents and avoid injuries.
I wish to extend thanks to the Webster Dudley Boys and Girl
Club for inviting me to participate in their “Education Day” held on
Thursday, August 10th. I was asked to read a book and
participate in a group activity with several young men and women in the
summer program. I was assigned to the "Goofy Goobers" and given the
book "Johnny Appleseed" to read. I enjoyed my time with the kids and
their counselors. I thank the staff of the Club for the invitation and
promoting positive programs for our young people.
