Recently, I was asked about the practice of people who drive cars with objects hanging from their rear view mirrors. The person was told it was illegal to have something displayed in this fashion. I was asked to explain further about this issue. This is another circumstance which cannot be clearly answered yes or no. It does depend on the situation. The law, which can apply in these cases, is found under Massachusetts General Laws Chapter 90 Section 13. It contains the definition for “impeded operation.” It states in part, “No person, when operating a motor vehicle shall permit to be on or in the vehicle or on or about his person anything which may interfere with or impede the proper operation of the vehicle or any equipment by which the vehicle is operated or controlled…” This definition covers many situations. According to this law, items cannot block windows, cover mirrors, or interfere in any way with a driver’s ability to safely operate the vehicle. The presence of items which may be large enough to qualify could be considered as an impediment to the clear view of a driver. The rules could apply to legitimate items, such s handicap placards. It can also pertain to other things such as dash ornaments, fuzzy dice, large air fresheners, windshield suction paper pads, etc. A violation of this law carries a $35 civil assessment. It is important to have a clear and unimpeded field of vision as well as a distraction free driver compartment. This law is in place for the safety of the driver, the passengers, and all others using the roadways. Take the time to remove items which may be a distraction. This small step could make a big difference in preventing an accident. As a reminder, The Dudley Patrolmen’s Association annual fundraiser is underway.
