I was
recently asked about a term quite often referred to in relation to
crimes. The person wanted to know the definition of "Breach of the
Peace." This is often cited in reference to various offenses, but
what does it mean?
The term "Breach of the Peace" can be interpreted in many
ways. Commonwealth Police Services provides the definition as "a
violation of public order and tranquility or any act or disturbance
which disrupts the public peace." This is not considered a crime on its
own. It is most often an "element" of a crime. Elements are considered
the parts of a particular offense. A breach of the peace can be
considered a broad based category which involves disruption of the
public peace. Certainly disorderly persons or fights can be considered
a breach of the peace.
Many terms and conditions in the law were established
through the common law when the country was first founded. They were
brought to this country from Europe. The "Breach of the Peace" is
perhaps one of those terms which people know but cannot properly
define. Public peace and tranquility is covered in many areas of the
law. This is usually something everyone wishes to enjoy, especially in
their homes.
